Terms of Service

The agreement between you and WhisqAI when you use the platform.

By accessing or using https://whisqai.comand any WhisqAI products or APIs (collectively, the “Service”), you agree to these Terms. If you don’t agree, don’t use the Service.

The Service is operated by Digitanomics Inc.(“WhisqAI”, “we”, “our”).

1. Who can use the Service

  • You must be at least 16 years old.
  • If you’re acting on behalf of a company, you confirm you have the authority to bind it.
  • You must not be barred from using the Service under any applicable law (sanctions lists, etc.).

2. Your account

You’re responsible for keeping your login credentials secure and for everything that happens under your account. Notify us right away at legal@whisqai.com if you suspect unauthorized access.

3. Acceptable use

We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your own business purposes. You agree NOT to:

  • Reverse-engineer, decompile, or attempt to extract source code.
  • Scrape the Service or use it to build a competing product.
  • Bypass rate limits, security controls, or paywalls.
  • Upload data you don’t have the right to upload.
  • Violate our Acceptable Use Policy.

4. API keys and the SDK

API keys are tied to your account and your responsibility. Don’t share them publicly or embed them in client-side code where they can be extracted. We may revoke keys that are leaked or used to violate these Terms.

5. Subscription, billing, and cancellation

  • Paid plans renew automatically at the end of each billing period until you cancel.
  • Cancel anytime from your account settings; the cancellation takes effect at the end of the current period.
  • Prices may change with 30 days’ notice for existing subscribers.
  • Refunds follow our Refund Policy.

6. Intellectual property

The Service — including software, benchmark data, brand assets, and documentation — is owned by Digitanomics Inc.. You retain ownership of any data, content, or game assets you upload. By submitting data to the Service, you grant us a non-exclusive licence to process that data solely to deliver the Service to you (and to compute anonymized aggregates that improve the platform).

7. Third-party services

The Service relies on third-party providers (see our Privacy Policy §4) and may integrate with third-party ad networks, analytics tools, or payment processors. We’re not responsible for their behavior; their terms apply to your use of them.

8. Warranties and disclaimers

The Service is provided “as is” without warranty of any kind. Revenue estimates, benchmarks, and analytics are informational — they’re not guarantees of actual game performance. We don’t warrant that the Service will be uninterrupted, error-free, or perfectly accurate.

9. Limitation of liability

To the maximum extent permitted by law, Digitanomics Inc.is not liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, or business opportunities. Our total cumulative liability for any claim arising out of or relating to the Service is limited to the amount you paid us in the 12 months before the claim, or USD $100 if you haven’t paid us anything.

10. Indemnification

You agree to defend and indemnify Digitanomics Inc. against claims arising from your misuse of the Service, your breach of these Terms, or your violation of any law or third-party right.

11. Termination

Either party may terminate at any time. We may suspend or terminate your account immediately for material breach (including abuse, fraud, or non-payment). On termination, your right to use the Service ends. Sections 6–10 survive termination.

12. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles. Disputes will be resolved in the courts of Delaware. If you’re a consumer in the EEA / UK, you keep all the mandatory rights of your home jurisdiction.

13. Changes and contact

We may update these Terms. Material changes will be announced by email or banner notice. Continued use after the update means you accept it. Questions: legal@whisqai.com.
